1. Introduction

This Privacy Policy explains how Softwareup Solutions SRL (“we”, “us”, “our”) handles personal data collected through our website. It covers what we collect, why, how long we keep it, who we share it with, and the rights you have under the General Data Protection Regulation (GDPR).

Our website is an informational site. We do not sell products or services through it, and we do not require you to create an account.

We process personal data as a data controller, which means we decide what data is collected and for what purpose. We are required by law to give you this information.

We recommend reading this Policy alongside our Cookie Policy. Where this Policy conflicts with our Terms and Conditions, this Policy prevails for matters of personal data.

We may update this Policy from time to time (see Section 11). The current version always applies from the date shown above.

2. Definitions

  • GDPR — Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
  • Controller (“we”) — Softwareup Solutions SRL, which determines the purposes and means of processing your personal data.
  • Data Subject (“you”) — any identifiable person whose data we process, such as a visitor to our website or someone who contacts us.
  • Personal data — any information relating to an identified or identifiable person, such as a name, email address, IP address, or online identifier.
  • Processing — any operation performed on personal data, including collection, storage, use, disclosure, and deletion.
  • Consent — a freely given, specific, informed, and unambiguous agreement to the processing of your data, given by a clear affirmative action.

Other terms have the meaning given to them by the GDPR.

We collect the following data when you use our website:

We collect this data directly from you (for example, when you submit the contact form) or automatically when you browse the site.

This list covers the data we expect to process through the website. We do not knowingly collect more than we need, and we do not make automated decisions that produce legal or similarly significant effects on you.

5. Cookies and analytics tools

Our website uses cookies and similar technologies. Cookies that are strictly necessary for the site to work are used on the basis of our legitimate interest. Analytics and other non-essential cookies are used only with your consent, which you give through our cookie banner and can withdraw at any time.

We use the following third-party analytics tools:

Google Analytics

We use Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. It uses cookies to collect information about how visitors use our site, such as pages viewed and time spent, in aggregated form. This data is transmitted to Google and may be processed on servers outside the EU (see Section 8).

Microsoft Clarity

We use Microsoft Clarity, a behavioral analytics service provided by Microsoft Corporation (and, for the EU, Microsoft Ireland Operations Limited). Clarity uses cookies and similar technologies to record how visitors interact with the site — for example clicks, scrolling, and mouse movement — and to generate heatmaps and aggregated session insights. This helps us see what works and what is confusing so we can improve the site. This data is transmitted to Microsoft and may be processed outside the EU (see Section 8).

6. How long we store data

We keep personal data only for as long as we need it:

  • Contact form messages — for as long as needed to handle your enquiry and for a reasonable period afterwards (up to [12–24] months), after which they are deleted.
  • Analytics data — for the retention period configured in each analytics tool, after which it is deleted or anonymized by the provider.
  • Technical/security logs — for a short period necessary to maintain security, then deleted.

If you want us to delete data we hold about you, contact us at contact@softwareup.io and we will do so where we have no legal obligation or overriding legitimate ground to keep it.

7. Who we share data with

We do not sell your personal data. We may share it only in the following cases:

  • Service providers (processors) acting on our behalf — for example our website hosting provider, email provider, and the analytics providers named in Section 5. We share only what is necessary, and we have contracts in place requiring them to protect your data and use it only as instructed.
  • Public authorities — such as courts, police, or regulatory bodies, where we are legally required to disclose information following a valid request.

8. International data transfers

Some of our providers (including Google and Microsoft) may process data outside the European Economic Area, including in the United States. Where this happens, the transfer is protected by appropriate safeguards under the GDPR, such as the European Commission’s Standard Contractual Clauses and/or an adequacy decision (for example, the EU–US Data Privacy Framework).

9. Your rights

Under the GDPR, you have the right to:

  • be informed about how your data is processed;
  • access the data we hold about you;
  • rectify inaccurate or incomplete data;
  • request erasure (“the right to be forgotten”) in the cases set out in Art. 17 GDPR;
  • restrict processing in the cases set out in Art. 18 GDPR;
  • data portability — receive your data in a structured, machine-readable format;
  • object to processing in the cases set out in Art. 21 GDPR, including processing based on legitimate interest;
  • withdraw consent at any time, where processing is based on consent (this does not affect processing carried out before withdrawal);
  • not be subject to a decision based solely on automated processing with legal or similarly significant effects;
  • lodge a complaint with the supervisory authority (see Section 10).
